The Effective Date of this Privacy Policy is September 1, 2011This Privacy Policy describes how Dering Hall, LLC (“Dering Hall,” “we”, “us”) handles personal information that we may collect from you in connection with your use of the Dering Hall website, at http://www.deringhall.com (the “Site”) and the services provided by Dering Hall on the Site. We welcome you to use the Site, which can be accessed and browsed without the need to submit any personal information. We strive to make sure that any personal information that you do provide to us is handled in an appropriate manner. By visiting or using the Site, you agree to the terms of this Privacy Policy. If you do not agree with these terms, please do not visit or otherwise use the Site.
1. The Information We Collect And How We Use It
(a) Personal Information That You Provide Dering Hall. Dering Hall collects the personal information that you provide us voluntarily, which includes your name and email address, when you send us a message, register with the Site, or subscribe to our newsletter. If you are a listed and approved designer user of Dering Hall’s Site, this information also includes your credit card account, contact and other business related information, which you provide to us voluntarily.
(i) Contacting Dering Hall. If you choose to contact Dering Hall through the Site, we will collect the data you provide to us voluntarily on the contact submission form, which includes your name and email address. We will use this information to respond to your inquiry.
(ii) Newsletters. If you choose to sign up for our newsletters, we will collect the data you provide to us voluntarily on the online forms, which includes your name and email address. We will use this information to send you our weekly email newsletter. You also automatically sign up for our newsletter when you create an account with Dering Hall.
We use a third party service provider to distribute our newsletter, and we share your name and email address with that service provider for this purpose. By creating an account with Dering Hall or signing up for the newsletter, you consent to the sharing of your personal information with our service provider. If you no longer wish to receive the newsletter, you may unsubscribe at any time by following the instructions contained in the email distributing the newsletter.
(iii) Registration with Dering Hall. If you choose to register with Dering Hall to obtain full access to the services that we provide on the Site, we will collect the data you provide to us voluntarily on the online forms, which includes your name and email address. We will use this information to send you Dering Hall’s weekly newsletter. We will also use this information to send you service related notifications and occasional emails advising of changes to Dering Hall’s Site or services or other administrative matters. You may not opt-out of these administrative messages, but you may deactivate your account at any time by emailing us at support@deringhall.com from the email address that you signed up with. If you are a listed and approved designer user of Dering Hall’s Site, we will also collect your credit card account, contact and other business related information, which you provide to us voluntarily. We will use this information to process your monthly payments to Dering Hall in accordance with our Fees Policy, send weekly email updates to members that choose to “follow” you on the Site, and the information in your storefront will be displayed on the Site to Dering Hall users and in offers for sales of your products to Dering Hall members.
(iv) “Follower” Features. You can choose to be a “Follower” of any listed designer on the Dering Hall Site by clicking on the “Follow” button while viewing any designer’s storefront. If you become a “Follower” of a designer, your email address and other personal information that you have provided to Dering Hall may be provided to that designer in order to send you email notifications and other information regarding the designer’s business, including announcements, events and new products. By choosing to “Follow” a designer, you consent to receiving email notifications regarding the designer and to the sharing of your personal information, including your name and email address, with that designer. Designers are not agents of Dering Hall, and Dering Hall does not control the privacy practices of the designers. Dering Hall will also send you one email per week to notify you of developments regarding each of the designers that you follow. If you no longer wish to follow a designer, you may click on the “Unfollow” button on your Dering Hall account page or on the designer’s storefront at any time. Dering Hall will attempt to honor “Unfollow” requests promptly, however, Dering Hall does not control the privacy practices of the designers or any other third party.
(v) Social Media Tools. You may choose to register with or log-on to the Site using third-party login credentials, such as your Facebook account information. If you are a listed and approved designer user of Dering Hall’s Site, you may choose to include a link in your Dering Hall storefront to your account on a third-party social media website, such as Facebook. If you are a listed and approved designer user of Dering Hall’s Site and you log on to the Site using your third-party social media account credentials, you may post notifications regarding new products on your social media account, such as on your Facebook wall. If you choose to register and log-on to the Site using third-party social media account credentials, or if you include a link to your social media account in your storefront, we will collect certain registration information from your social media account, which includes your name and email address, and additional information that may be necessary to authenticate your access to the Dering Hall Site in the future. If you log-on to the Dering Hall Site using third-party social media account credentials, and you choose to “Follow” a Dering Hall designer, you consent to Dering Hall posting a notification on your social media account, such as on your Facebook wall, that you are “following” that designer. You may opt-out of these social media posts at any time by emailing us at support@deringhall.com or by changing your preferences on your account page.
(b) Cookies; Aggregated Data That Is Automatically Collected. When you visit the Site, we automatically collect certain aggregate information about how our Site is being used. This information may include your IP address, the date, time and pages that you visit on the Site, and other information related to your visit and use of the Site. Your information may be combined with the information of other users and we may use it to improve the Site, learn more about how the Site is being used, and provide you with more relevant advertising.
Like most websites, the Site may place a “cookie,” or small text file, in the browser of a visitor’s computer. This cookie is stored on your computer and will assign you a unique number that allows Dering Hall to save information so that the information does not need to be re-entered by you. You can generally remove these cookies by following directions provided in your Internet browser’s “help” file and you can also configure your browser to accept all cookies, reject all cookies, or notify you when a cookie is set. If you choose not to allow us to place a cookie on your hard drive, you may be restricted from some pages and services on the Site.
We may also work with third parties, including Google, that place cookies or “web beacons” (electronic images placed in the code of a web page that monitor online traffic patterns) on the Site. These companies collect and provide to us certain aggregate information about your visit to the Site, including your IP address. This aggregated information, which we do not tie to your personal information, helps us operate our Site and provide you a better experience. 2. Sharing Your Information With Other Dering Hall Users
(a) Content In Your Storefront. If you are a listed and approved designer user of Dering Hall’s Site and you create a storefront on the Site, you may post certain personal information related to your business that is accessible to the public, and you may receive unsolicited messages from members in return. By posting content in a storefront, it is also possible for users to re-post that content outside of the Site. Dering Hall is not responsible for any re-posting of your content, and you agree to hold Dering Hall harmless for any disputes regarding such re-posting. This is a public forum and you should assume anyone and everyone can see what you post via the Internet.
(b) Communicating With Other Users. If you communicate with a Dering Hall designer, to inquire about or purchase a product or otherwise, you will provide the designer with your personal information (including your name and email address and, in the case of a purchase, your payment and shipping information). Without express consent, designers should only contact members and use their personal information for Dering Hall-related communications and for completing the transaction for which the information was provided. Designers should not use this information to distribute unsolicited commercial messages. Unless a member “follows” the designer, or the member consents, designers should not add members to their email lists.
If you choose to purchase a product directly from a designer through the Site, the transaction is processed and completed between you and the designer, without Dering Hall’s involvement. This means that your personal information, including your credit card or other account information, will be subject to the designer’s privacy policies, which we do not control, and which may be different than Dering Hall’s privacy policy. We recommend carefully reviewing the designer’s privacy policies before entering into any transaction with the designer.
3. Disclosure Of Your Personal Information With Third Parties
Dering Hall will not share your personal information with any third party without your permission, except in the following circumstances: (i) as set forth in this policy (for example, to our service providers); (ii) in response to a subpoena or when we are required to do so by law (for example, in response to a court order or other legal obligation); (iii) in response to a law enforcement agency’s request; (iv) to protect the security or confidentiality of our records; (v) in special cases when we have reason to believe that disclosing this information is necessary to identify, contact, or take necessary action against someone who may be causing injury to or interference with our or our users’ rights, or (vi) if Dering Hall goes through a reorganization (e.g., a merger into another organization), in which case you will be notified via an announcement on the Site or otherwise, as we deem appropriate.
We may share your personal information with certain trusted third parties to help us operate the Site and improve our business, or for marketing purposes. For example, we may use third parties to host our data and the personal information of our users, provide customer service, complete purchases, distribute our newsletter, and for other services necessary to operate the Site or that may provide you a better experience on the Site. We use a third party payment processor in connection with our featured sales program and to process designer fee payments. If you choose to enter into a featured sales transaction with Dering Hall or sign up with Dering Hall as a listed and approved designer user, your payment and, in the case of featured sales transactions, your shipping information (and any other information that may be required to complete the transaction) is provided directly by you to our service provider and will be used by our service provider to complete your transaction. Personal information provided by you to our service provider is subject to that service provider’s privacy policy, which we do not control. We do not have access to the payment information that you provide to that service provider.
We do not control the privacy or security practices of third parties with whom your personal information is shared pursuant to this Privacy Policy, whether they are Dering Hall users or not. The Site may also contain links to third party websites, which are not controlled by Dering Hall and which are not covered by this Privacy Policy. You are responsible for reviewing the privacy policies of all such third parties, and we recommend that you read these policies very carefully before disclosing your personal information to any third party, whether directly or indirectly.
4. Security Of Your Information
Dering Hall uses reasonable precautions to protect your personal information and to store it securely. Your personal information will be stored on a third party server located in the United States and will be password protected. The server on which we store personal information is kept in a reasonably secure environment. You should be aware, however, that no method of transmission over the Internet or method of electronic storage is 100% secure.
5. Correcting / Updating Your Information
If you are a registered Dering Hall member, you may access and update your registration information by sending an email to us at support@deringhall.com. If you are a listed and approved designer user of Dering Hall’s Site, you may access and update your storefront information and content at any time through our password-protected Content Management System. If you have any concerns about how your personal information is being used by Dering Hall, please let us know by sending us an email at support@deringhall.com.
6. Collection And Use of Children’s Personal Information
You must be at least eighteen (18) years old to use this Site. We do not solicit any personal information from children. If you are under the age of eighteen (18) you may not use the Site.
7. Changes In This Privacy Policy
Our privacy policy may change in the future. We encourage you to review this page periodically to understand our policy regarding our collection and use of personal information, and to contact us at support@deringhall.com if you have any questions or concerns. If we change this privacy policy in any material manner, we will post the amended policy here and/or notify you by email or other means that we deem appropriate. Your continued use of the Site after notification of material changes to this privacy policy constitutes your consent to the changes.
